WINTER WEATHER CONTRACT PROVISIONS


Know Your Contractual Rights!

Now that the winter weather is upon us we want to remind members how to conduct themselves in accordance with the contract.  Please recall that certain contract provisions were changed (renegotiated) from last contract:

  • If you have scheduled PL, VAC or sick leave during the time of a shift cancellation, you are no longer required to burn the PL, VAC or sick leave if your shift (or any portion thereof) is canceled.
    • Accruals will still be charged if you had leave scheduled for the entire week.
  • Essential employees -  If you are required to work during a shift cancellation (full or partial), in addition to your regular pay, you receive comp time for the hours worked.
  • If the Governor delays the start of the day during inclement weather until 11:00 am or later, then everyone is expected to report to work at 11:00 (or later as declared).  However, if the Governor does not delay the start time until 11:00, then the normal one hour grace period described in Article 16 Section six applies, along with the additional one and half hours grace period, based on severity of conditions and in comparison to others similarly situated.

In any instance, any excess delay in arrival can be made up during the pay period or covered with vacation/pl time.

ACTUAL CONTRACT PROVISIONS

SHIFT CANCELLATIONS
Article 18 Section 3(b)
When a shift off (or any portion thereof) is granted by the act of the Governor (or his/her designee) an employee scheduled to charge vacation accruals or personal leave on that shift shall not be charged.  However, this provision shall not apply in the event the employee had leave scheduled the entire work week (e.g.: Monday - Friday)

Article 19 Section 5
Employees scheduled to be out sick shall not be charged a sick day if the state is closed by act of the Governor (or his/her designee).  During the employees work shift (or any portion thereof) however. this provision shall not apply in the event the employee had leave scheduled for the entire workweek (e.g.: Monday-Friday).

DELAYED OPENINGS
Article 16 Section 6 (last paragraph)

In the instance of a Governor (designee) delayed opening of 11:00AM or later, article 16 section 6 of the A&R contract shall not apply and employees shall be expected to arrive at the Governor (designee) declared start time.  In instances where an employee arrives after the Governor (designee) declared start time, said employee may opt to either make up the extended delay or charge said excess time to accrued leave.  In all other regards, including delayed openings prior to 11:00 AM, Article 16 section 6 and MOU VIII language shall control.

ESSENTIAL EMPLOYEES
Article 16 Section 7
When an employee is required to work despite the Governor (designee) ordering a closing of some or all of that employee's normal shift, the following shall apply: In addition to any overtime involving the shift, the employee shall receive straight compensatory time, in addition to the employees' regular pay, for the hours worked during the employee's normal shift when the State has been ordered closed.

You can’t rescind a resignation! Even if you are threatened with termination, do not resign – at least not until you get advice from the union. It may end up being the best option in some cases, but you will have no option if you put your signature on a resignation letter.

A&R's 37th Annual Holiday Party

A&R's 37th Annual Holiday Party is fast approaching.  Festivities occur Friday, December 7th, beginning at noon, at the Aqua Turf in Southington.  Lunch will be served at 1:00pm.  Please join us as we celebrate the holidays with our union brothers and sisters.

Payment for tickets by mail must be received in A&R's office by Wednesday, November 21st.  Deadline for walk in payments at the A&R office is Wednesday, November 28 at 12:30 p.m.  No tickets will be sold at the door.  The party is open to all active members, and their guests.

PLEASE BRING AN UNWRAPPED TOY WITH YOU TO THE HOLIDAY PARTY

Remember: we are conducting a toy drive at the Holiday Party in conjunction with the United Labor Agency.  The United Labor Agency Toy Drive directly benefits labor families in need.

Every year our labor family comes together to ensure that other families in need have a happier holiday season. It is a testament to the generosity of our labor family that as the need has grown, so has the support for this event.


KNOW YOUR CONTRACTUAL RIGHTS
You have a contractual right to attend the holiday party without charging time.  Page 90 of the the A&R contract, Memorandum of Understanding III specifies that: employees of the A&R bargaining unit will continue to be eligible to receive one-half day off with pay to attend one annual picnic and one holiday party.  Said picnic and holiday party must be sponsored by the A&R Union or the emplying agency of the employee.  Employees with alternative work schedules,which would include the day of the event as a non-work day, may adjust their work schedule for the week in which the event is scheduled making the event day a scheduled work day.

 

 

RC 43 TRIF-ic News Late Fall 2018

RC 43 TRIF-ic News is the newsletter of NYSUT Retiree Council 43, Teacher Retirees In Florida. It is published bi-monthly, September - August.

The NYSUT Retiree Contiguous E.D. 51-53 Meeting was held in Albany New York October 3-4, 2018. RC 43 President Deb Peterson, RC 43 Southeast Trustee and FLARA member Bill Cea and RC 43 Treasurer Marsha Friedman were the delegates attending this meeting from our RC 43 Council.

Election Results Are In

Although not all of the State House/Senate seats have been decided, the winners for the Constitutional Offices of Connecticut have been declared.  We want to congratulate the new leadership team in Connecticut (each of whom received A&R's endorsement).

Membership Meeting Minutes - October 2018

MEMBERSHIP MEETING 

OCTOBER 15 & 17, 2018

Our Fall 2018 membership meetings were held on October 15, 2018 at the Main Campus of Essex County College and October 17, 2018 at the West Essex Campus, where the agenda was repeated.

Some of the highlights discussed at the meetings were as follows:

·      Essex County College is requiring completion of the Safe Colleges Online Training, which includes Title IX and FERPA.  Our members were encouraged to complete the training and print out the Completion Certificates and send the Certificates to Human Resources to be filed.

·      The Chairman of the College’s Professional Development Advisory Committee asked that our members submit suggestions of Professional Development activities they would be interested in attending.   

·      We discussed the issue of 504 accommodations that students present to classroom teachers.  Suggestions were made to make the process more confidential, secure and timely.  Those suggestions were passed along to the Director of Student Development and Career Counseling.

·      Unemployment Insurance (UI) for Adjunct Faculty is an ongoing concern.  The matter is still an important project with AFT.  Members were asked to submit to us, in writing, any stories they have of trying to get UI.  

·      The benefits of membership were discussed in addition to the latest attempts at “union busting” taking place in the country. Members were warned of what to be aware of and to let us know if they are approached by some of those organizations.

·      In order to enhance our organizing efforts, we are offering $10 to each member who signs up a new, eligible, member.

·      The new contract was distributed.  We asked that everyone be familiar with it.  To that end, members made suggestions of proposals for the next round of contract negotiations.  

·      The AFT’s benefit of Accidental Death and Dismemberment was explained and the Beneficiary Forms were distributed and completed. This benefit is of no additional cost to the members.

·      Emphasis was made for adjunct faculty to come to the officers with any concerns or problems they are facing before going to ECC Administration.  We have been able to successfully intervene on our member’s behalf.  

·      The two retroactive payments that adjunct faculty received on June 8 and 22 was explained.  The College paid a total amount of $936,442  

·      Our dues structure to AFT national, AFTNJ and Local 2222 was outlined. 

·      The College is looking forward to the 50thanniversary of its first graduation.  Activities are planned throughout the year to commemorate this event. There will be a Gala on May 2, 2019.

·      Our members were made aware that the scholarship applications for Adjunct Faculty and students are currently on our website. We also announced that we would like to honor those adjunct faculty who have taught at ECC for 30 or more years. Last year we honored Terry Benjamin, Ngari Ngunjiri, and Joseph Nwokwo at our scholarship luncheon.  This year a few more names are coming forward.

·      The meeting ended with a prominent reminder to be sure to VOTE on November 6, 2018
